1. Who This Applies To

The Services are intended only for individuals who are at least eighteen (18) years old. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will take steps to delete it. If you believe a minor has provided us information, contact us at legal@eloportal.io.

2. Information We Collect

2.1 Information You Provide

We collect information you provide directly, which may include: your name, email address, and any details you submit when you join our waitlist, create an account, contact us, or sign up for communications; content you submit to the Services, such as esports clips or video; and any other information you choose to provide.

2.2 Wallet and Transaction Information

If you connect a digital wallet or transact on the Services, we may collect your public wallet address and information about your transactions, including Portals you mint, buy, sell, or trade. Please note that blockchain transactions are public by nature. Information recorded on a public blockchain, including wallet addresses and transaction history, is publicly visible and is not controlled by us.

When you use the Services, we may automatically collect certain technical information, such as your IP address, browser type, device information, pages viewed, referring pages, and general usage data. We may collect this information using cookies and similar technologies (see Section 6).

2.4 Information From Third Parties

We may receive information about you from third-party service providers, such as analytics providers, authentication or verification vendors, payment processors, and wallet or blockchain infrastructure providers, consistent with their own policies.

3. How We Use Information

We use the information we collect to:

  • Provide, operate, maintain, and improve the Services.
  • Create and manage accounts, process transactions, and deliver Portals and related features.
  • Authenticate and verify content submitted to the Services.

  • Personalize and improve your experience and develop new features.
  • Monitor for, detect, prevent, and address fraud, abuse, security issues, and violations of our Terms.
  • Comply with legal obligations and enforce our agreements.

4. How We Share Information

We do not sell your personal information for money. We may share information in the following circumstances:

  • Service providers: with vendors who perform services on our behalf, such as hosting, storage, analytics, authentication, payment processing, and customer support, who are permitted to use the information only to provide those services.
  • Blockchain networks: information necessary to record transactions on a public blockchain, which is then publicly visible.
  • Legal and safety: when we believe disclosure is necessary to comply with law, legal process, or government requests, to enforce our Terms, or to protect the rights, property, or safety of Elo Portal, our users, or others.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case information may be transferred as part of that transaction.
  • With your consent: when you direct us to share or otherwise consent to sharing.

5. Data Retention

We retain personal information for as long as necessary to provide the Services, fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Note that information recorded on a public blockchain is permanent and cannot be deleted by us.

6. Cookies and Tracking Technologies

We and our service providers may use cookies, web beacons, and similar technologies to operate and improve the Services, remember your preferences, and analyze usage. You can usually control cookies through your browser settings. Disabling cookies may affect the functionality of the Services. For more detail, see our Cookie Policy.

7. Your Choices and Rights

Depending on where you live, you may have certain rights regarding your personal information, such as the right to access, correct, delete, or restrict the use of your information, the right to data portability, and the right to opt out of certain processing. You may also opt out of marketing emails at any time by following the unsubscribe instructions in those emails. To exercise any rights, contact us at legal@eloportal.io. We will respond consistent with applicable law. Please note we cannot alter or delete information stored on a public blockchain.

8. Security

We use reasonable administrative, technical, and organizational measures designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and wallet, including your private keys and seed phrase, which we never collect or store.

9. International Users

We are based in the United States, and the Services are operated from the United States. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries that may have different data protection laws than your jurisdiction. By using the Services, you consent to such transfer and processing.

10. Third-Party Services

The Services may link to or integrate with third-party services, including wallets, blockchains, and marketplaces, that have their own privacy practices. We are not responsible for the privacy practices of any third party, and we encourage you to review their policies.

11. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice. Your continued use of the Services after changes become effective constitutes acceptance of the revised Policy.
